Terms of Service

Welcome to Hablacha, an AI-powered language learning platform operated by SiteSpan Limited ("SiteSpan," "we," "us," or "our"), a company registered in Ireland.

By accessing or using the Hablacha platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Account Types and Acceptable Use

Hablacha offers two distinct categories of accounts. You must use the account type that matches your actual use case.

1.1 Individual Accounts (B2C)

Individual subscriptions (such as our Standard or Elite plans) are intended solely for personal, non-commercial use by a single individual.

  • No Account Sharing: You may not share your login credentials with anyone else.
  • Age Restriction: You must be at least 16 years old to create an Individual Account.

1.2 Enterprise and Educational Accounts (B2B)

If you are using Hablacha on behalf of a school, university, company, or other organisation, you must purchase an Enterprise/Educational licence.

  • Anti-Cannibalisation Clause: It is strictly prohibited for educators, schools, companies, or organisations to purchase multiple Individual Accounts for classroom or organisational use. It is also prohibited for a teacher or organisation to use a single Individual Account and share it among multiple students or employees.
  • Violation: Using Individual Accounts for institutional, classroom, or organisational purposes is a material breach of these Terms. SiteSpan Limited reserves the right to immediately terminate any accounts found to be in violation of this clause without prior notice and without a refund.
  • Enterprise use is subject to these Terms as well as any separate Master Service Agreement (MSA) and Data Processing Agreement (DPA) signed between your organisation and SiteSpan Limited.

2. Artificial Intelligence and Content Rules

Hablacha utilises advanced third-party Artificial Intelligence (AI), including Large Language Models (LLMs) and Text-to-Speech (TTS) services, to facilitate roleplay conversations.

  • No Malicious Prompts: You may not use the Service to generate illegal, harmful, highly offensive, or sexually explicit content. You may not attempt to "jailbreak," reverse-engineer, or otherwise manipulate the underlying AI prompts that power the Service.
  • Nature of AI: You acknowledge that AI systems can occasionally produce inaccurate or nonsensical responses (hallucinations). SiteSpan Limited does not guarantee the complete accuracy of AI-generated translations, grammar corrections, or cultural advice.
  • Intellectual Property: You retain ownership of the voice and text inputs you provide to the Service. SiteSpan Limited retains all intellectual property rights to the underlying software, platform design, and pre-written scenario prompts.

3. Subscriptions, Payments, and Refunds

3.1 Billing

By subscribing to a paid plan, you authorise SiteSpan Limited (via our payment processor, Dodo Payments) to charge your selected payment method on a recurring basis (monthly or annually) until you cancel.

3.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. You will retain access to the Service until the cycle ends.

3.3 EU Right of Withdrawal and Refund Waiver

Under EU consumer law, you generally have a 14-day "cooling-off" period to withdraw from a purchase of digital content.

However, by subscribing to a paid Hablacha plan and immediately accessing the Service, you provide your express consent for the immediate delivery of digital content and acknowledge that you thereby lose your statutory 14-day right of withdrawal.

Because you are granted immediate access to our proprietary AI generation tools upon payment, we do not offer refunds for partial billing periods or unused time, except where explicitly required by mandatory local law.

3.4 Pre-registration reward

People who pre-register for Hablacha on Google Play and then sign into Hablacha on Android with the same account receive, once, a founder badge, 2 bonus streak freezes, and 5 bonus roleplays.

The bonus freezes and bonus roleplays are used after the normal monthly allowance. They are not cash, not a subscription, and not transferable.

The reward is unavailable if the Play purchase cannot be confirmed. SiteSpan Limited can end the campaign when pre-registration ends.

4. Service Availability and Rate Limits

We strive for high uptime, but the Service relies on third-party APIs (including DeepSeek and ElevenLabs). SiteSpan Limited is not liable for temporary outages caused by these upstream providers.

To ensure fair use and prevent abuse of expensive AI resources, we enforce rate limits. If your usage significantly exceeds the typical usage patterns of other users on the same tier, we reserve the right to temporarily throttle or suspend your access.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SiteSpan Limited and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

6. Governing Law and Jurisdiction

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

7. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.

8. DMCA Notice & Copyright Policy

Hablacha respects the intellectual property rights of others. If you believe that any material available on or through the Service infringes upon any copyright you own or control, please submit a written notification to our Designated Copyright Agent containing:

  • A physical or electronic signature of the copyright owner or authorized representative.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing with sufficient detail for us to locate it.
  • Your contact information (name, address, telephone number, and email address).
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
